The Present Scenario

The respective company has opened its subsidiary unit in India at Goa. This office was supposed to give support, facilitate & train the affiliates.

Few days back, i.e. on 2^nd of January, 2013, the local English News Paper “Team Herald”, reported regarding the closure of Goa Office after Police took action against an FIR filed against the company by an ex-employee, CEO and Director of Banners Broker India, Mr Edney Heredia.

The Indian Authorities are investigating the nature of business proposal that this company was promoting as Ponzi Schemes, Pyramid Schemes or MLM/ Network Marketing Business System.

The Police & Economics Offences Cell are investigating the violation of the Prize Chits and Money Circulation Schemes (Banning) Act 1978 as well as illegal promises on part of money invested.

The Goa police have seized computers & documentation from the office and hence the premises are temporarily out of bounds for Public and Associates/ Affiliates.

The Indian subsidiary unit has been charged under IPC 406, 420 and also under section 4, 5, 6 of the PCMC (banning) act 1978, i.e., is false commitment & illegal promises made to collect fund as well as Prize Chits and Money Circulation Schemes (Banning) Act.

My Opinion

The whole issue has cropped up because of certain differences & indifferences between the Banners Broker International and the ex-employee, CEO and Director of Banners Broker India, Mr Edney Heredia.

Firstly, the issue has blown out of proportion and most of the affiliates have presented the system of Banners Broker International as Multi Level Marketing Plan. This is due to inefficient leaders and inadequate knowledge regarding the system & company.

Secondly, for lust of extra money some people may have hijacked the respective company’s systematic presentation and interpreted as per their thinking.

My Conclusion

Banners Broker India and Banners Broker International have both cooperated with the Indian Administration & have full faith on Indian judicial system and have full confidence that the above issues would be resolved properly within a short span of time.

The legal process takes some time to settle to an amicable & judicious conclusion.

Few major points in favor of Banners Broker India and Banners Broker International are given below:-

ü  Banners Broker India Private limited is registered in India and is a reseller of the products of the Mother Company. Hence, it is a genuine, legal, legitimate, taxpaying, advertising & publishing company.

ü  The Marketing Plan of Banners Broker India Private limited is such that you will earn only when you work. Hence, it is not MLM or Network Marketing Plan.

ü  Banners Broker India Private limited collects fund from the sale to the Indian affiliates in the country in its accounts in India, pays all taxes as per the tax guidelines and pays to the people who have completed the Advertising Job.

So the company as per my view does not come under the PCMC (banning) act of 1978.

The office is closed, but response from the Government Authorities is in favor of Banners Broker India and Banners Broker International and have some what understood that whole affair took under the influence of false information presented by ex-employee, CEO and Director of Banners Broker India, Mr Edney Heredia.
